right to refuse to host any web site offering such content.
We are pleased to offer our clients
unlimited Web page traffic. To maintain the integrity of our service, the
following restrictions apply:

Multiple hosts resolving at an
IP or domain name that we provide.

Sites with excessive banners, graphics or
cgi's running from their domain used on other domains.

Sites with large archives or
galleries (.gif, .jpg, exe, zip, tar, etc.)
-
Sites offering a large number
of download files. (This is any site where 20% or more of their
monthly traffic is from file downloads.)
-
Sites using more than 20% of
system resources.
Warning:
We do not allow unsolicited bulk email (SPAM)
to be sent in reference to domains on our servers. Such violations result
in immediate removal of your web site. If you do not know what this means
or have questions please ask before ordering.
Telnet
access is also not available, SSH can be set up on certain packages.
All services provided by Surf22
Hosting.com may be used for lawful purposes only. Transmission or
storage of any information, data or material in violation of any Federal,
Provincial, State or City law is prohibited. This includes, but is not
limited to: copyrighted material, material legally judged to be
threatening or obscene, or material protected by trade secret and other
statue. The subscriber agrees to indemnify and hold harmless Surf22
Hosting.com from any claims resulting from the use of the service
which damages the subscriber or any other parties.
Payment is due immediately after
the date of each invoice. All setup fees are non-refundable once setup has
been completed. The subscriber is responsible for providing up-to-date
payment information. Surf22 Hosting.com will not be held
responsible should the subscriber's payment information become
out-of-date.
Past Due Policy
7 days past due - Remote FTP access
disabled
14 days past due - Disk rebuilt for other customer
All files, information and mail
under the account will be preserved for 7 days from the date the payment
is due. If the payment is not received after 7 days Remote FTP
access will be disabled. After 14 days all files, information and mail
under the account will be deleted. If the subscriber wishes to use the
service again, the subscriber must re-apply as a new subscriber. For this,
an activation fee will be required.
The subscriber agrees that the
company has the right to delete all data, files or other information that
is stored in the subscriber’s account if the subscriber’s account with
the company is terminated, for any reason, by either Surf22 Hosting.com
or the subscriber.
Additional Policies
System accounts can not be
transferred or used by anyone other than the subscriber.
The subscriber must certify that
he or she is at least 18 years of age.
Surf22 Hosting.com shall have
the right to suspend service to the subscriber at any time, and for any
reason, without notice. If such a suspension is to last for more than 30
days, the subscriber will be notified as to the reason.
IRC
IRC or IRC bots may not be operated on our servers at this time.
Server Abuse
Any attempt to undermine or cause harm to a server or customer of Surf22
Hosting is strictly prohibited.
Cancellation
Service provided by Surf22 Hosting.com
may be cancelled in writing at any time with no
penalty. Login Id and domain name must be included in the cancellation
request. Cancellation will take effect only when the receipt of the
cancellation request is confirmed. Surf22 Hosting.com reserves the right
to change the rate by notifying the subscriber 15 days in advance of the
effective date of the change.
Content
Surf22 Hosting.com
exercises no
control whatsoever over the content of the information passing through Surf22 Hosting.com.
Surf22 Hosting.com
makes no
warranties of any kind, whether expressed or implied, for the service it
is providing. Surf22 Hosting.com also disclaims any warranty of
merchantability or fitness for a particular purpose. Surf22 Hosting.com will not be responsible for any damage suffered. This includes loss of
data resulting from delays, nondeliveries, misdeliveries, or service
interruptions caused by Surf22 Hosting.com negligence or the
subscriber's errors or omissions. Use of any information obtained via Surf22 Hosting.com
is at your own risk. Surf22 Hosting.com specifically denies any responsibility for the accuracy or quality of
information obtained through its services.
Should any provision of this
agreement be held to be illegal, invalid, or unenforceable by a court law,
the legality, validity and enforceability of the remaining provisions of
this agreement shall remain unaffected thereby unless otherwise stated.
These Terms and Conditions
supersede all previous representations, understandings or agreements and
shall prevail notwithstanding any variance with terms and conditions of
any order submitted. Use of Surf22 Hosting.com service constitutes
acceptance of these Terms and Conditions.
Failure to follow any term or condition above will be
grounds for immediate account deactivation.
